Gadget Club is a part of ThePhoneLab and is subject to the general terms and conditions of ThePhoneLab B.V.
1. Definitions
1.1 ThePhoneLab B.V. and Gadget Club, hereinafter referred to as "ThePhoneLab and Gadget Club," are created with the purpose of repairing broken smartphones and tablets.
1.2 In these general terms and conditions, ThePhoneLab and Gadget Club include all their employees.
1.3 In these general terms and conditions, the term "Customer" refers to a natural or legal person who uses the services of ThePhoneLab and Gadget Club.
1.4 In these general terms and conditions, the term "Services" refers to the activities carried out by ThePhoneLab and Gadget Club, including but not limited to the repair of Products and the collection or delivery of these Products.
1.5 In these general terms and conditions, the term "Products" refers to equipment, such as smartphones and tablets, delivered by Customers for repair.
1.6 In these general terms and conditions, the term "Original parts" refers to both new original parts and parts taken from original equipment.
1.7 In these general terms and conditions, the term "Website" refers to www.thephonelab.nl / www.gadgetclub.shop.
2. Applicability of these conditions
2.1 These general terms and conditions apply to all Customers of ThePhoneLab and Gadget Club.
2.2 Deviations from these general terms and conditions are only valid if they have been expressly agreed upon in writing with ThePhoneLab and Gadget Club.
3. Agreement
3.1 The agreement is concluded at the moment when an offer or proposal from ThePhoneLab and Gadget Club is accepted by the Customer.
3.2 If, due to circumstances unknown at the time of the conclusion of the agreement, additional work needs to be carried out, ThePhoneLab and Gadget Club are entitled to charge these costs to the Customer. If the Customer objects, they may cancel the work not yet performed. The Customer is obliged to reimburse ThePhoneLab and Gadget Club for the work already performed on their Product.
3.3 If a Customer wishes to cancel the Order, this can only be done for the part of the work that has not yet been performed.
4. Execution of Services
4.1 Customers with an appointment have priority over Customers without an appointment.
4.2 When submitting the Product, ThePhoneLab and Gadget Club may request the access code to test certain functions. If a customer provides this access code, they give consent for ThePhoneLab and Gadget Club to use this code to test functions. The customer is NOT obligated to provide the access code to have their device repaired.
4.3 ThePhoneLab and Gadget Club have the right to restore the Product to its original factory settings.
4.4 The Customer is responsible for providing the correct information to ThePhoneLab and Gadget Club.
4.5 ThePhoneLab and Gadget Club strive to use Original parts for their repairs. If this is not possible, parts of the highest achievable quality are used.
4.6 ThePhoneLab and Gadget Club have the right to engage third parties in the execution of their Services.
4.7 ThePhoneLab and Gadget Club aim to complete common repairs within 30 minutes.
4.8 If the Product is not collected within one week, the Customer will be notified. If the Product is not collected after 30 days, ownership will transfer to ThePhoneLab and Gadget Club.
5. Warranty, costs, and payment
5.1 After repair by ThePhoneLab and Gadget Club, the customer has a lifetime warranty on the functioning of the replaced part. This warranty does not cover
glass or LCD cracks and other visible user damages caused by falls, impacts, pressure, water, or misuse.
5.2 Although ThePhoneLab and Gadget Club use the highest quality parts, they cannot guarantee that the manufacturer's warranty on the product will remain valid.
5.3 If it is not possible to repair the Product, the Customer is not required to pay. In the case of water damage, investigation costs will be charged.
5.4 The costs for repairs are as stated on the Website of ThePhoneLab and Gadget Club.
5.5 These costs must be paid directly by Customers in-store upon collection of the Product. Business Customers can pay on account.
5.6 Phones that are manufactured to be waterproof by the manufacturer may lose their water resistance after repair. After a repair, ThePhoneLab and Gadget Club are not liable for the water resistance of a device.
5.7 Refurbished devices, batteries, and accessories are covered by a 12-month warranty.

6. Liability
6.1 ThePhoneLab and Gadget Club have a best-effort obligation towards the Customer. Therefore, they cannot be held liable for not achieving the desired result.
6.2 If ThePhoneLab and Gadget Club are held liable, they will only be liable for direct damages actually incurred, paid, or suffered by the Customer due to a demonstrable failure to fulfill their obligations regarding their Services, and this liability is limited to a maximum of the invoice value for the repair of the Product.
6.3 Any claims by the Customer due to failures on the part of ThePhoneLab and Gadget Club will expire if they are not reported in writing and with reasons to ThePhoneLab and Gadget Club within a period of fourteen (14) days after the Customer became aware or reasonably should have been aware of the facts on which they base their claims.
6.4 ThePhoneLab and Gadget Club are not liable for the loss of data.
6.5 ThePhoneLab and Gadget Club are not liable for damages to Products caused by force majeure situations, including but not limited to burglary, leakage, fire, and flooding.
6.6 ThePhoneLab and Gadget Club will adequately insure and maintain insurance coverage for the damages mentioned in article 6.4. They will pay out the received insurance compensation proportionally to the Customer.
6.7 In the event of total loss of a Product, the current value of the Product will be used for compensation, and it will be reimbursed in the same manner as stated in article 6.6, up to a maximum of 250 Euros. ThePhoneLab and Gadget Club are not obligated to replace the entire Product under any circumstances.
7. Identity
7.1 ThePhoneLab B.V. is registered in the Chamber of Commerce under number 68108044. ThePhoneLab has the following VAT identification number: 857305141B01. ThePhoneLab is also statutorily registered at Beethovenstraat 94, (1077JN) in Amsterdam, which is also the visiting address of ThePhoneLab and Gadget Club.

8. Applicable law and competent court
8.1 Dutch law applies to the legal relationship between ThePhoneLab, Gadget Club, and their Customers.
8.2 Any disputes arising between ThePhoneLab, Gadget Club, and their Customers will be settled by the competent court of the Amsterdam District.
